Please read these Terms & Conditions ("Terms") carefully before using the My Weather application and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years old and agree to comply with these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

My Weather is a progressive web application that provides weather forecasts, AI-generated humorous commentary, push notifications, and related features. The Service is provided on an "as is" and "as available" basis.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You agree to provide accurate and complete information when creating your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to reverse-engineer, decompile, or disassemble any part of the Service
Interfere with, disrupt, or place an undue burden on the Service or its infrastructure
Use automated systems (bots, scrapers) to access the Service without prior written consent
Impersonate another person or entity
Circumvent any access restrictions or security measures

5. Weather Data and AI Commentary

Weather forecasts are provided for informational and entertainment purposes only. While we strive to deliver accurate data from reliable sources (Open-Meteo), weather predictions are inherently uncertain. We make no guarantees regarding the accuracy, completeness, or reliability of any weather data or forecasts.

AI-generated commentary is created for entertainment purposes. It does not constitute professional advice of any kind. You should not rely on the Service as your sole source of weather information for safety-critical decisions.

6. Push Notifications

By enabling push notifications, you consent to receiving weather updates, alerts, and related messages. You can disable notifications at any time through your device settings or the app. We will never send advertising or promotional notifications from third parties.

7. Premium Features and Payments

Certain features may require a paid subscription ("Premium").
Payment is processed securely through Dodo Payments. We do not store your payment card information.
Subscription fees are billed in advance on a recurring basis according to the plan you select.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change applies to their account.

8. Intellectual Property

All content, design, code, graphics, logos, and trademarks associated with the Service are owned by My Weather or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure
Weather data or forecasts will be accurate or reliable
AI-generated content will be appropriate, accurate, or inoffensive
The Service will meet your specific requirements
Any defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY WEATHER, ITS OPERATORS, AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your use of or inability to use the Service
Any inaccuracy in weather data, forecasts, or AI-generated content
Any decisions made based on information provided by the Service
Unauthorized access to or alteration of your data
Any third-party conduct on or related to the Service
Any other matter relating to the Service

11. Indemnification

You agree to indemnify, defend, and hold harmless My Weather and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page. Material changes will be communicated through the Service. Your continued use after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and My Weather regarding the Service.

17. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.
